Posting and Validating XML issues - Please Help

I am posting an XML file using the Microsoft object ServerXMLHTTP send method.

The problem is when I include <!DOCTYPE cXML SYSTEM &quot; in the file I receive the error &quot;The system cannot locate the resource specified&quot;. When I post the file without including this line it is posted sucessfully. Also when I post I am going through a proxy server.
Has anyone had problem validating against the cXML dtd.
