Error 159 License Exceeded

Seems like with the upgrade of NBU 4.5 to 5.1 it will no longer back up my cluster, which is a virtual server. The cluster is active/active. I now get a license exceeded error. It is using a San Media Server license. This worked before in 4.5 and tech support even verified with us that this would be all we needed when we brought 4.5. Now it seems they are saying that you can not backup a remote client with San Media Server and that I need to make it a media server instead. They stated that with the upgrade the code was changed. Is there a way around this. Why would they change this now. Another way to make more money.
 
First off. I don't support the decision to do this by Veritas. It seems that there was nothing in the code to prevent San Media servers from being able to be general media servers and perform other client backups in 4.5 and below. Of course the San Media server license was less expensive. Prior to our upgrade to 5.x we were told of this 'new' wrinkle and of course the 'why' it was being done. So prior to the upgrade we had the chance to verify and double check our licenses, turns out we were OK. I really tried to get across my point that anything in an upgrade path license-wise that can cause software to stop is BAD!. Put up a nag screen or warning that you have xx days to get the license correct. Doubt it had an effect, but I suggested it. There is no workaroud I'm aware of, but try support or your local salesperson.
