I'm looking at setting up a website (the example below is not my intention but the principal is there)
Suppose I want to set up a website ( that details where a good pint is pulled (this is not my intended website - honest).
Would I be able to list places (myself or devoted web-site visitors have visited) where perfect pints have been pulled.
Where do I stand in naming the pubs and / or putting up a picture of the pub in question on the webpages ?
In all cases the remarks would be flattering (this is for praise not put-downs).
If I was to take a picture of a member of staff with said pulled-pint would I need the owners permission ?
Or is this just like taking a pic of mates and putting it on a website ?
I must stress that the website (albeit fictional) will be done with the aim of listing (and showing) places where the perfect pint is available.

Anyone give me any pointers with this ?

Thanks in advance

Steve

Hi mate,

This depends on who you are taking the photos of and how much you want to cover yourself legally.

If there are any visable human faces in the image, they you should by rights have a model release form saying that they agree to you using the image for certain purposes.

There should be no visible trademarked products, corporate identity, logos, or copyrighted elements in the photos either.

If it is just a few pictures of freinds, then I really cannot see there being a problem. Are any of your freinds likely to sue you for this?

Hope this helps Wullie

So does everyone publishing pictures of places / establishments on the web have to get appropriate permission ?
Surely there are umpteen people with pics on the web taken in pubs or in posession of brand names ?
As long as I'm not claiming them as my own would I be OK ?

It is all about information. You don't necessarily need a release for a photo of an establishment, but you may if you plan on selling or capitalizing from the use of the photo.

I agree on the people too. Using a person's photo should be accompanied by a model release form in most cases.

Best rule of thumb is that if you are concerned about it...get permission anyway. It can never hurt to ask and it could save you lots of trouble in the long run.

Besides...I'd go in and have a few pints just to get the permission if it were me!
