PCTel HSP 56k Modem and Hardware/Voice issues

Currently I having a issue with my 56k modem. With the phone line connected to the modem, the modem will keep the line open, even with the pc off. I'm sure this is a hardware issue considering it pretains to voice but considering the modem type I would say that buying a new modem would be a better fix, but What I am asking is with a soft-modem are issues like this common ?
 
yes and no. yes, because about half of the modems we replace had this issue you are having. no, because that figure is based on all modems, both software and hardware. you have to remember most people have winmodems.

if i'm understanding correctly, as soon as you plug the phone line in the modem, it will "pick up" the line, right? or is it that after making the connection it won't close the port?
