The system is CM 4.0 with MOH on a VAL. The situation is that the Executive is on a call and a second incoming call routes to the Attendant who places the caller on hold hearing music. Meanwhile the Executive finishes the fist call and notices a call on the second line appearance. If the Executive picks up that held appearance the caller and music create a conferene with the Executive. In other words, the MOH does not release. If the Attendant takes the second call off hold and transfers to the Executive before the Executive can grab the appearance, MOH is not heard (of course). What have I programmed incorrectly or is MOH using a VAL problematic?

Sounds to me like it is working like it should. If it is a problem, give the attendant a COR without MOH.
