Is Arcserve compliant with the Data Protection Act (UK)?

I just received a phone call from a company that has "reliably" informed me that BrightStor Arcserve is not compliant with the data protection act. As far as I'm aware from what I have read, the actually software itself does not have much to do with the actual compliance, as it's more down to company policy, but i'm not 100% sure about this. Does anyone have a more definite idea, should i be looking for something else, or is this nothing more than a sales ploy?

Arcserve is just a tool, it is what a company does with the tool that determins compliants with the DPA. Arcserver is no differant to any other software. Let me guess the guy on the phone wanted to sell you something.
 
A pencil and paper can be used to break the DPA in the wrong hands.
 
From what i had read about the DPA it seemed odd to me that just by not using specific software we can be breaking it. It was a salesperson trying to tell me after all, but alarm bells rang. Unfortunately, it's not always that easy to lay your fears to rest about this type of matter.
