That's a nice piece of sensationalism. The answer is easy:
Put your policy on a paper titled "Consent Form" and make the employee sign it. As long as you're not violating local law it will hold up in court.

as the article points out - a consent form may be sufficient in states that have single consent, but not dual consent.

the conflicting state laws and who has jurisdiction in any case still seems conflicted.

the implications for forensics seem interminable in a corporate or domestic situation.

like others here i am not a lawyer, don't play one on tv, and my advice is worth what you pay for it! but i have stayed in a holiday inn express!
 
here is a question (based on the info in the above referenced article) - if i did a grep word search on a local pc and it revealed messages (from a web-based email program such as yahoo or hotmail) would that be considered monitoring?
