Comms ports all in use ?

I have a laptop (see spec below) that appears to have all the comms ports locked by another application. This came to light when using the modem. I am unable to querey the device as the comms port is open, however when i try and change the com port that the modem uses it tells me that it is in use by another application (although i choose a coms ports that isn't listed as in-use). This happens for every coms port i can choose.
I've checked what programs are operating, there are none that would required access to any coms port or lock out a coms port. I've checked the modem drivers which are up to date, and i've also been through the registy,services,and processes killin anything that shouldn't be operational - but no joy.

Anyone have any ideas? I've got about 10 other laptops same spec that this hasn't arisen on. This laptop has just started doing it.

Windows 2000 SP4 on a Toshiba Tecra S1 laptop. Internal Toshiba AMR modem.
 
I have toshiba laptop.
Com port for the modem is selectable in the bios
either as com3 or com4.
There must be no serial ports installed in
device manager for theese .
