Audix Hacking Attempts-fraud?

This may be more of a legal question than a technical question, but if someone is calling into our Audix main number, and entering extensions and passwords so that they get locked up, is that fraud? There are no traditional costs, i.e. toll charges, being generated. I do not believe this person is trying to hack a mailbox and take control. Instead, I think their main purpose may be to lock the mailboxes of selected officers of our company as a way of hassling them. (disgruntled ex-employee)

Anybody out there know of any resources to research our legal options? I'm seeing this as being similar to locking up someone's account on the Internet, or at their bank, etc. Not sure of our recourse.
 
If it gets to bad you could always change the extension leading to the hunt group for voice mail. Alot of work but it might work for while. Wisdom is Knowledge

I think the laws vary from state to state, You might want to check with your states reulatory dept.
This probably would fall under a type of hacking, because if the person would happen to get lucky and hit the correct password he would be able to retrieve and/or delete possible sensative information.
 
I would think this falls under the same thing as a DOS (Denial of Service) attack on the internet. Hit a website w/ so many requests that it can't service legitimate requests.

In that case, it is considered hacking.

Besides, "You don't know their intensions." You assume they aren't trying to break in. However, the evidence supports a hacker pattern and I would think you could prosecute as such.

If you opt to change the lead number on the hunt, keep in mind that if they call an extension and get the audix greeting, they can **r and get the log in menu.

I had a client that this happened to. They had CDR & caller ID, but all the calls were coming from different pay phones. They had a good idea of who it was and hired a private investigator to tail him. They caught & prosecuted him.......
