No , there is no licensing problem, there is a known problem with this service being unstable, and CA unofficially advise the course of action of restarting the service before brick lvl backups.
Unfortunately scheduling this is turning out to be more tricky then expected as this service...
Thanks that works for one of the services, but unfortunately the other gives me an error "this is not an installed service" its the backup RPC service for arcserve 9 by the way DBASVR.exe

Can someone give me some tips on how to schedule the Backup Agent RPC service to stop/start before my backup job runs.

I had a "similar" issue... it was resolved by using the device patch from support.ca.com Q051045.caz, also if you havent as previously stated disable drivers to changer + tape drive.
If you havent updated to this patch I suggest you give it a try "whats the worst that can happen!"
