ProxyHost and EMC Snapshots

Hi,
Running Simpana 7.
We are attempting to back up snapshots of an NTFS file system on our EMC using ProxyHost. Most of the time it works fine but once every week or 2 the back up fails on the scan phase because the snapshot is corrupt. CV support have washed their hands saying it is an EMC problem and EMC say it is a CV problem because ProxyHost is not using VSS.
Has anyone succeeded in getting this configutation working?
